General terms for the psychological online counseling
These terms govern the use of this website and all contracts for psychological online counseling between you and Helms Psychology, Katharina (Kira) Helms, Hauptstrasse 20, 5444 Künten, Switzerland, email: katharina@helmspsychology.com ("I" below).
Services
I offer psychological online counseling via video call. Counseling is not psychotherapy within the meaning of the Swiss Psychology Professions Act and not medical treatment; it supports you with life issues, stress and personal development and does not replace medical or psychotherapeutic care. I do not treat mental illnesses. If there are signs of a concern that requires treatment, I will say so and recommend suitable services. Counseling is not an emergency service: in acute crises please call 144 (Switzerland) or 112 (EU) or contact the nearest psychiatric emergency unit. As a service, I owe careful counseling in line with professional standards, not a particular outcome.
Conclusion of contract
You book appointments via the booking calendar on this website (free introductory call) or via the client area (counseling sessions). The contract for a session is concluded when you receive the booking confirmation by email. The offering is directed at adults.
Prices and payment
The prices shown on the website at the time of booking apply. All prices are final prices. Sessions and session packages are paid in advance; once payment is received, your session credit is activated in the client area. The introductory call is free and non-binding.
Rescheduling and cancellation
You can reschedule or cancel a booked session free of charge up to 24 hours before it starts, using the links in your booking confirmation or in the client area. If you cancel later or do not attend, the session counts as used and is deducted from your session credit, unless you were prevented through no fault of your own. Your statutory right of withdrawal (see below) remains unaffected. If I have to cancel an appointment, I will offer you a replacement; credit you have already paid for is preserved.
Right of withdrawal for consumers in the EU
If you are habitually resident in the European Union and book as a consumer, you have a statutory right of withdrawal. Instructions on withdrawal: You have the right to withdraw from this contract within fourteen days without giving reasons. The withdrawal period is fourteen days from the day the contract is concluded. To exercise the right, you must inform me (Helms Psychology, Katharina (Kira) Helms, Hauptstrasse 20, 5444 Künten, Switzerland, email: katharina@helmspsychology.com) of your decision to withdraw by an unequivocal statement (for example an email). Sending the notice before the period expires is sufficient to meet the deadline. Effects of withdrawal: If you withdraw from this contract, I will refund all payments received from you without undue delay and no later than fourteen days from the day I receive your notice. I will use the same means of payment you used for the original transaction; you will not be charged any fees for the refund. Early performance: If you ask for a session to take place before the withdrawal period expires, you thereby expressly request that I begin performing before the period ends. If you then withdraw, you owe a reasonable amount for the services already provided. The right of withdrawal expires once the service has been performed in full, if performance began only after your express consent and your acknowledgement that you lose the right of withdrawal upon full performance.
Your cooperation and technical requirements
For video counseling you need a stable internet connection and a device with camera and microphone. Where possible, choose a quiet, undisturbed environment. Please answer questions about your situation truthfully, in particular the questions distinguishing counseling from concerns that require treatment.
Confidentiality and data protection
As a psychologist I am bound by professional secrecy under Art. 321 of the Swiss Criminal Code. Details on how your personal data, including health data, is processed can be found in the privacy policy on this website.
Liability
I am liable without limitation for intent and gross negligence and for injury to life, body or health. Otherwise I am liable only for the breach of essential contractual obligations and limited to the foreseeable damage typical for this kind of contract. These limitations do not apply where mandatory law provides otherwise.
Final provisions
Swiss law applies. If you are habitually resident in a member state of the European Union, the mandatory consumer protection rules of that state remain unaffected by this choice of law. Should individual provisions of these terms be invalid, the remainder of the contract remains effective. I may amend these terms for future contracts; the version published at the time of your booking applies. For the note on consumer dispute resolution, see the imprint.
